TERMS AND CONDITIONS FOR ONLINE BOOKING
1 - Preliminary stipulations
These present terms and conditions constitute a remote contract, characterizing the rights and obligations of the Syndicat Mixte Mémorial Alsace-Moselle.
Called hereafter the ‘Mémorial’ and its clients wishing to purchase individual tickets via this website.
Relating to the Mémorial Alsace-Moselle.
Called hereafter the ‘website’.
The purchase of group tickets, from 15 paid persons, is not governed by these present terms and conditions. Groups are invited to contact our booking service.
The website is an online booking website allowing clients to buy tickets to visit the Mémorial.
Clients are exclusively customer, described as natural persons not acting within their commercial, industrial, handmade, freelance or agricultural activities.
Orders made on this website are compulsory destined for a personal use. The resale, the utilisation or transformation of the tickets for commercial use is forbidden, except with the Mémorial’s authorization.
These present terms and conditions cancel and replace the previous conditions. Placing an order implies the full and unreserved compliance of the client to the terms and conditions for online booking hereafter stated which prevailed over any other document such as printings, flyers, promotional brochures, descriptions of products emitted by the Mémorial.
The Mémorial takes the greatest care with the essential characteristics of the offers and their information uploading online regarding this; the Memorial commits to answer every request for further information or the offers.
In any event, the Mémorial’s responsibility won’t be engaged by potential changes or mistakes concerning the characteristics’ description of the tickets bought, unless the essential characteristics of the products are affected.
The Mémorial reserves the right to modify or update at any time and without advance notice these terms and conditions of sales. Therefore, the terms and conditions applied are those online at the day of the order by the client.
2 - Order and payment
2.1. The client declares having the capacity to conclude the present contract, i.e. having the legal majority and not being under administrative supervision or guardianship.
The client will place the order according to the indications given on the website. The client commits himself to complete their order, making sure to give the necessary, complete and exact information. The client is responsible for the given information while placing their order, to the extent that the Mémorial can not be held responsible for any error.
2.2. The steps for ordering on the website are these followings.
- Choice of the tickets and options :
Selection of the place the client wishes to visit ;
Indication of the number of persons concerned by the visit ;
For the option, choice of a date and the time slot ;
Information on the potential free and/or reduced fees the client can benefit ;
The client gets to the Mémorial’s offers matching their different criteria.
The client can then personalize their visit by adding paid options.
The option for the children guided tour ‘Jean ou Hans, quelle histoire’ if this option is available depending on the wanted date of the visit.
The option for the discovery tour, if this option is available depending on the wanted date of the visit.
The option for the guided tour ‘L’histoire à la lampe torche’, if this option is available on the wanted date of the visit.
The option for the guided tour of the temporary exhibition, if this option is available depending on the wanted date of the visit.
The option for the guided tour ‘Vorbruck-Schirmeck, sur les traces d’un camp oublié’ if this option is available depending on the wanted date of the visit.
The client accesses to the summary of their order.
The client has the possibility to verify the characteristics of their order and to modify it by going back.
The choice of the tickets is realized under the sole responsability of the client.
The client validates their order by clicking on the icon ‘Payment’.
Identification : if the client is already registered on the website, they complete the boxes provided by indicating their login details and their personal password. If the client is not yet registered on the website, they need to create an account by completing the provided boxes and indicating their contact details with these following mandatory informations: titles, surname and name, email and phone number. The client can choose to order with our creating a user account, they will not have the ability to modify their chosen time for the visit or to purchase options after the order of tickets.
Validation of the terms and conditions : the client declares to have read and accepted these present terms and conditions by ticking the corresponding box. The client definitively confirms their order by clicking on the icon ‘Payment’.
Payment : the client choses their mode of payment and then proceeds with the payments by the transfer on the secured website of the bank partner of the Mémorial.
The order is payable in euros and in full : At no time these deposited sums can not be accounted as deposit or down payments.
The payment is carried out by card (Visa or MasterCard).
In case of a refusal of the car used by the payment center, the order is automatically cancelled.
- Confirmation of the order and delivery of the tickets : once the order paid, the client can print out the page recapitulating up their order. In consequence, the client will receive a confirmation of their order by email. The recap of the order has to be kept. It constitutes the proof of the client’s order and of the contract binding the parties. The email confirming the order contains the e-tickets the clients has to present to the front desk of the place of the visit and the potential options subscribed.
2.3. In any case, the Mémorial reserves the right to do not accept an order for legitimate reason, notably for a problem concerning the understanding of the order received, a foreseeable problem concerning the delivery or an abnormality in the quantity ordered in view of the standard needs of a consumer or an order implicating the ethics of the Mémorial.
In case of a no acceptance of the order, based on a legitimate reason, the Mémorial will inform the client by email. The Mémorial has the right to do not satisfy every exorbitant demand of the client or contrary to the common law and its general terms and conditions, or in case of an ongoing litigation with the client.
3 - Characteristics of the tickets and options
3.1. Rates and free
The prices of the tickets mentioned on the website are indicated in euros, including taxes, the VAT applicable being the ones in effect at the moment of the order.
The Mémorial has the right to modify its selling prices at any moment. However, no posterior modification of the order taking can not be applied.
The client and/or visitor entitled to a free or reduced ticket can proceed to an online booking on the website. They need to show an ongoing nominative justification and which a photograph upon the control of the ticket at the front desk of the place of the visit. In case of the no presentation or no conformity of the justification, the client has to pay the full price or the complementary fees necessary. 3.2. Validity and use of the tickets
The tickets can be downloaded or printed out from the email confirming the order.
The access to the place of the visit is subjected to the control of the ticket’s validity. To this end, the printed ticket or the e-ticket has to be scanned at the front desk.
The modification or manipulation of the tickets are forbidden. The tickets need to be presented unaltered as they have been printed out or downloaded.
The first person to present the ticket is supposed to be the legitimate holder. The access of the Mémorial or to the event will be denied to any other person coming later on with a copy of the ticket.
The visitor has to keep their ticket during the visit.
Tickets shall be valid a year from the date the ticket was issued.
The ticket of the Mémorial gives access to the place only for the day stated on the ticket.
It the client do not use their ticket during the validity period, the ticket shall be definitively lost.
It is strictly forbidden to reproduce, duplicate or counterfeit a ticket or any document for the visit or to make them available for this aims or to use copies of these documents. Such deeds are liable to penal prosecution, without the prejudice done for the Mémorial. The Mémorial should have the right to reclaim from the offender the damage suffered by them.
The client and the visitor have to respect the rules of procedures of the place of the visit and the security measures, made mandatory by ways of laws or regulatory.
4 - Absence of right of withdrawal
The article L.221-28 of the Consumer Code foresees that the right of withdrawal can not be exerted for the contract for accommodation services, catering or leisure activities which have to be provided at a specific date or to determined frequency or periodicity.
The sales of tickets for a museum or services provided by its being assimilated to a sale for leisure activities; the client is informed they do not benefit any right of withdrawal.
5 - Reclamation - Liability
5.1. Every complaint relative to an order or a visit has to be addressed to the Mémorial by email or letters to the contact details figuring at article 8, and within seven (7) days after the online purchase.
The client needs to provide all the proofs concerning the ascertained anomalies. The client needs to attach to their reclamation. The receipts of the purchase and the visit (confirmation of the order, entry tickets…).
5.2. The Mémorial shall not be held responsible for the temporary or permanent damages caused to the client’s software or any losses or eventual damages underwent resultingly to the access or the browsing on websites. The data transmission via internet can generate the production of errors and/or the fact the website can not always be available. Therefore, the Mémorial shall not be held responsible for the availability and the interruption of the online service.
5.3. The choice and the use of the ticket are under the sole responsibility of the client.
The Mémorial declined any responsibilities in the event of loss or theft or the utilisation of tickets’ copies unbeknownst to the client, including inside the Mémorial.
6 - Intellectual property / Personal datas / Opposition to cold calling
6.1. The entirety of the website (illustrations, texts, wordings, brands, images, logos, videos) is the property of the Mémorial. The integral ou partial reproduction of the website is strictly forbidden, except if the Mémorial gives its authorization priory. The Mémorial do not authorize the creation of hypertext link, except with prior and express consent from the Mémorial.
Save contrary stipulation, the Mémorial keeps the intellectual property of its creation (savoir-faire, royalties, brands, etc.) which shall not be used, presented, released, adapted and translated without its written and priorly authorization. In any case, the client shall use the documents transmitted accordingly to the aim declared with the Mémorial.
6.2. The Mémorial proceeds to the collect and the data processing of the clients in accordance with the current regulations for the personal data and to the Privacy policy elaborated and which completed the current terms and conditions for sales which it is a part of.
6.3. The client is informed they can register them on an opposition list for cold calling (‘Bloctel’ List). It is precise the registration do not forbid the Mémorial to contact the client by phone for the strict necessities of the execution of this present contract.
7 - Applicable laws - Mediator
The parties acknowledge the present conditions and their consequences are subjected to the French laws. The language of the documents and the relationship between the parties are French.
The client is informed of the possibility to resort in case of argument to a conventional mediation or any other alternative ways to resolve dispute.

Before seizing the mediator mentioned above the client pledges to address their reclamation to the Memorial firstly at the contact detail mentioned on the article 8.
Furthermore, the Mémorial informs the client of the existence of the website to settle litigations made by the European Commission and the possibility to resort to it in case of litigation linked with the present contract.
